DinkDish (“DinkDish,” “Company,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the DinkDish platform (“Platform”) to do the same.

This DMCA and Copyright Policy (“Policy”) describes the procedures for submitting copyright infringement notifications, responding to claims under the United States Digital Millennium Copyright Act (“DMCA”), and addressing other intellectual property concerns relating to content available through the Platform.

## 1. Scope of Policy

This Policy applies to all content available through the Platform, including but not limited to:

• user-generated content;
• reviews and comments;
• photographs and images;
• graphics and logos;
• videos and multimedia;
• blog posts and written content; and
• other materials uploaded, posted, displayed, or transmitted through the Platform.

## 2. Reporting Copyright Infringement

If you believe that any content available on the Platform infringes your copyright or other intellectual property rights, you may submit a written notification to DinkDish’s designated copyright agent. To be effective under the DMCA, your notification must substantially include the following:

• identification of the copyrighted work claimed to have been infringed;
• identification of the allegedly infringing material and information reasonably sufficient to permit DinkDish to locate the material;
• your full legal name, mailing address, telephone number, and email address;
• a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• a statement, under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner; and
• your physical or electronic signature.

## 3. Counter-Notification Procedures

If you believe that content you posted to the Platform was removed or disabled as a result of mistake or misidentification, you may submit a written counter-notification.

A valid counter-notification must include:

• identification of the material that was removed or disabled and the location where it appeared before removal;
• your full legal name, mailing address, telephone number, and email address;
• a statement under penalty of perjury that you have a good faith belief the material was removed or disabled due to mistake or misidentification;
• a statement consenting to the jurisdiction of the federal court located in the district where your address is located, or if outside the United States, consenting to jurisdiction in the Commonwealth of Massachusetts; and
• your physical or electronic signature.

Counter-notifications should be sent to the designated copyright agent listed above.

## 4. Repeat Infringer Policy

DinkDish reserves the right to suspend or terminate accounts of users who are determined, in DinkDish’s sole discretion, to be repeat infringers of intellectual property rights.

DinkDish may also limit access to the Platform or remove content where appropriate to protect intellectual property rights or comply with applicable law.

## 5. Removal and Investigation Rights

DinkDish reserves the right, but not the obligation, to:

• remove or disable access to allegedly infringing content;
• investigate suspected infringement claims;
• request additional information from complainants or users;
• preserve records relating to disputes;
• cooperate with law enforcement or legal authorities; and
• take any action deemed appropriate to protect the Platform and applicable rights.

DinkDish may remove or restrict content without prior notice.

## 6. Misrepresentations

Any person who knowingly materially misrepresents that material or activity is infringing, or that content was removed by mistake or misidentification, may be subject to liability under applicable law.

## 7. Other Intellectual Property Claims

For complaints relating to trademarks, publicity rights, impersonation, counterfeit goods, or other intellectual property concerns not specifically governed by the DMCA, please contact DinkDish using the contact information below.

## 8. No Legal Determinations

DinkDish does not independently determine whether content infringes intellectual property rights and does not act as a court or adjudicator in disputes between parties.

DinkDish’s response to notices or counter-notices does not constitute a legal determination regarding ownership, infringement, or liability.

## 9. Reservation of Rights

DinkDish reserves all rights relating to enforcement, moderation, investigation, and protection of intellectual property rights on the Platform.

Nothing in this Policy limits any rights or remedies available to DinkDish under applicable law or under the DinkDish Terms of Service.

## 10. Changes to This Policy

DinkDish reserves the right to modify or update this Policy at any time.

Updated versions become effective upon posting to the Platform.

Continued use of the Platform constitutes acceptance of any revised Policy.
